01 Do I need a trademark in every class?
You only need to register in the class(es) relevant to your business. However, if your brand spans multiple businesses (e.g., food + retail + technology), filing in multiple classes gives broader protection. We advise on the optimal class selection for your specific business.
02Can I use ® before my trademark is registered?
No — the ® symbol can only be used after the trademark is officially registered. Using ® before registration is a criminal offence under the Trade Marks Act. You can use ™ (which indicates a claimed mark) from the date of filing.
03 What if someone is already using my brand name?
If the mark is already registered in your class by another party, we advise on alternative names or classes. If the existing registration is inactive or in a different class, there may still be filing options. If your mark has been copied by someone after your use began, we can advise on passing-off actions.
04 Can a foreign company register a trademark in India?
